1. Acceptance of Terms

By accessing or using Race Challenges, you agree to be bound by these Terms of Service and all applicable laws and regulations in the jurisdiction of Trinidad and Tobago and the wider Caribbean. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Eligibility

You must be at least 13 years old to use Race Challenges. If you are under 18, you must have parental or guardian consent. You must provide accurate and complete registration information and are responsible for maintaining the security of your account.

Race Challenges allows registered adult users (18 years or older) to enroll children between the ages of 13 and 17 ("Minor Participants") in virtual challenges through the "My Family" feature. Minor Participants do not have independent accounts; all activity is managed through the parent or legal guardian's account.

• Minor Participants must be at least 13 years of age to be enrolled in any challenge.
• Minor Participants may appear on public leaderboards using their first name and last initial.
• The enrolling adult is solely responsible for ensuring the Minor Participant's fitness and ability to safely complete the chosen challenge.

3. Google Sign-In

By signing in with Google, you authorize Race Challenges to access your basic Google profile information (name, email, profile photo) for authentication purposes only.

• You can disconnect your Google account at any time from your profile settings.
• Race Challenges is not responsible for issues with Google's authentication services.
• We do not access any other Google services beyond basic profile authentication.

4. Communications and Notifications

By creating an account or registering for events on Race Challenges, you consent to receive email communications from us, including but not limited to event updates, registration confirmations, submission notifications, promotional content, and platform announcements.

• Transactional emails related to your registrations, submissions, payments, and account activity are required for service delivery and cannot be opted out of.
• Promotional emails about new events, challenges, merchandise, and community updates may be opted out of at any time via the unsubscribe link in each email or through your profile settings.
• Race Challenges may send communications to the email address associated with your account or provided during event registration.
• If you register another person as a guest for an event, you confirm that you have obtained their consent to share their email address with Race Challenges and for them to receive event-related communications.

5. Challenge Participation

Participation in virtual races and exploration challenges carries inherent physical risks. Users are responsible for their own safety and health while participating. Race Challenges and its parent company, Caribbean AI and Data Solutions Limited, assume no liability for injury, loss, or damage incurred during challenge activities.

Registration

• Event registration is required to participate in challenges.
• Registration fees, if applicable, are non-refundable unless otherwise stated.
• Limited capacity events are first-come, first-served.

Activity Submissions

• All submitted activities must be genuine and completed by you.
• Activities must be completed within the event timeframe.
• We reserve the right to verify submissions and request additional proof.
• Submissions may be rejected if they do not meet event requirements.

Medals

• Medals are awarded upon successful completion of event requirements.
• Medal collection locations and times are specified for each event.
• Medals not collected within the specified period may be forfeited.

6. Payment Methods and Billing

Accepted Payment Methods

For event registration fees and other purchases, we accept the following payment methods:

• Visa credit and debit cards
• Visa Debit
• Mastercard credit and debit cards

All card payments are processed securely through Wam.

Payment Processing

• Payment Processor: All card payments are securely processed by Wam, our PCI-DSS compliant payment service provider.
• 3D Secure: Card transactions may require 3D Secure (3DS) authentication for enhanced security. You may be redirected to your card issuer's verification page.
• Card Information: Your card details are tokenized and encrypted. Race Challenges does not store your full card information.
• Transaction Authorization: By completing a payment, you authorize Race Challenges to charge the specified amount to your payment method.

Billing and Receipts

• You will receive an email receipt upon successful payment.
• All prices are displayed in USD unless otherwise specified.
• Registration fees are charged when you complete the registration process.

Refunds and Cancellations

• Event registration fees are generally non-refundable.
• Refunds may be considered on a case-by-case basis for special circumstances (medical emergencies, event cancellations).
• If a refund is approved, it will be processed to the original payment method within 5-10 business days.

• Partial refunds may be issued for events that allow transfers to future dates.

7. Account Responsibility

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

8. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or misleading activity data.
• Use automated tools or bots to interact with the platform.
• Attempt to manipulate leaderboards or rankings.
• Harass, abuse, or harm other users.
• Violate any applicable laws or regulations.
• Interfere with the proper functioning of the platform.
• Share your account credentials with others.
• Create multiple accounts to circumvent rules or limits.

9. Intellectual Property

All content on Race Challenges, including but not limited to logos, designs, text, graphics, and software, is the property of Race Challenges or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

10. User Content

By submitting content to Race Challenges (including activity data, photos, and profile information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our services. You retain ownership of your content.

11. Disclaimer and Assumption of Risk

Participation in running, walking, cycling, or other physical activities carries inherent risks. You acknowledge that you are voluntarily participating and assume all risks associated with your activities.

Health Disclaimer

Consult with a healthcare professional before beginning any exercise program. Race Challenges is not responsible for any injuries or health issues that may occur during your activities.

Platform Disclaimer

Our platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

12. Limitation of Liability

To the maximum extent permitted by law, Race Challenges and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or participation in events.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the platform will immediately cease.

14. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform. Your continued use of Race Challenges after changes constitutes acceptance of the modified Terms.

15. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Trinidad and Tobago and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
