Terms of Service
1. Acceptance of Terms
By accessing or using Race Challenges, you agree to be bound by these Terms of Service and all applicable laws and regulations in the jurisdiction of Trinidad and Tobago and the wider Caribbean. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Race Challenges for personal, non-commercial transitory viewing only.
Under this license, you may not:
- Modify or copy the materials.
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
- Attempt to decompile or reverse engineer any software contained on the platform.
- Remove any copyright or other proprietary notations from the materials.
3. Challenge Participation
Participation in virtual races and exploration challenges carries inherent physical risks. Users are responsible for their own safety and health while participating. Race Challenges and its parent company, Caribbean AI and Data Solutions Limited, assume no liability for injury, loss, or damage incurred during challenge activities.
4. Payments and Refunds
Entry fees for challenges are handled through WiPay and Wam. All transactions are final. Refunds are only issued in the case of technical failure of the platform as determined by our support team.
5. Account Responsibility
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
6. Minor Participants
Race Challenges allows registered adult users (18 years or older) to enroll children between the ages of 12 and 17 ("Minor Participants") in virtual challenges through the "My Family" feature. Minor Participants do not have independent accounts; all activity is managed through the parent or legal guardian's account.
- Minor Participants must be at least 12 years of age to be enrolled in any challenge.
- Minor Participants may appear on public leaderboards using their first name and last initial.
- The enrolling adult is solely responsible for ensuring the Minor Participant's fitness and ability to safely complete the chosen challenge.
7. Parental Consent & Liability
By enrolling a Minor Participant, the parent or legal guardian:
- Represents and warrants that they have the legal authority to consent on behalf of the minor.
- Acknowledges that participation in virtual challenges involves physical activity and assumes all inherent risks on behalf of the Minor Participant.
- Agrees to indemnify, defend, and hold harmless Race Challenges, Caribbean AI and Data Solutions Limited, its officers, directors, employees, and agents from any and all claims, damages, losses, or expenses arising from the Minor Participant's participation.
- Accepts full responsibility for any injury, illness, or harm that may occur to the Minor Participant during challenge activities.
Race Challenges does not independently verify the guardian relationship between the enrolling adult and the Minor Participant. Misrepresentation of guardianship is a violation of these Terms and may result in immediate account termination.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Trinidad and Tobago and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
